By Bizodisha Bureau, Bhubaneswar,March 03:Former director general (DG) of Odisha police Sanjeev Marik on Tuesday filed a criminal defamation suit against former police inspector general (IG) and ex-Lok Sabha member of Cuttack, Anadi Sahu, in Bhubaneswar Sub-divisional Judicial Magistrate (SDJM) Court.
Mr Marik filed the case for Rs 50 lakh under Sections 500, 501 and 502 of the Indian Penal Code (IPS) on grounds that Sahu’s allegations linking him to gangster Dhalasamanta brothers have damaged his reputation.
On February 20, the former IG Mr Sahu had alleged that Marik had close links with the gangster brothers.
Later on February 23, he also charged that Mr Marik had pocketed Rs 7 crore from arrested brothers – Sushil Dhalsamanta and Sushanta Dhalsamanta.
The ex-IG said that Mr Marik’s now transferred stenographer Rabindra Sethi used to take care of his illegal transactions and invested them in various places.
Mr Marik, on the other hand, had demanded evidence of his claim and had threatened to drag the matter to the court as we reported here.
Section 500 of IPC deals with punishment for defamation. It states that ‘whoever defames another shall be punished with simple imprisonment for a term which may extend to two years, or with fine, or with both.’
Section 501 of IPC deals with printing or engraving matter known to be defamatory. It states that ‘whoever prints or engraves any matter, knowing or having good reason to believe that such matter is defamatory of any person, shall be punished with simple imprisonment for a term which may extend to two years, or with fine, or with both.’
Section 502 of IPC deals with sale of printed or engraved substance containing defamatory matter. It states that ‘whoever sells or offers for sale any printed or engraved substance containing defamatory matter, knowing that it contains such matter, shall be punished with simple imprisonment for a term which may extend to two years, or with fine, or with both.’
